The following Regulations specify the general terms and conditions of sale applicable in the online store available at www.bujnie.pl, operated by Grow Idea Group Szymon Serej, with its registered office at ul. Pod Lasem 78, 44-210 Rybnik, NIP (Tax ID): 6423048738, REGON (National Business Registry Number): 364550170. The economic activity is registered in the Central Registration and Information on Business Activity (CEIDG), maintained by the Minister competent for economy.
1. Scope of Application of the Regulations
1.1. These Regulations shall apply to all orders placed by Consumers and Entrepreneurs via our online store.
1.2. A Consumer, pursuant to Article $22^1$ of the Civil Code, means a natural person performing a legal transaction with an entrepreneur which is not directly related to their business or professional activity.
1.3. An Entrepreneur, pursuant to Article $43^1$ of the Civil Code, means a natural person, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, conducting business or professional activity in its own name.
1.4. Any alternative or supplementary Regulations and General Terms and Conditions utilized by Entrepreneurs shall not apply – they shall become part of the contract exclusively if we grant our express written consent thereto.
2. Conclusion of the Contract and Fulfillment Procedure
2.1. The contract of sale shall be concluded with the entity Grow Idea Group Szymon Serej.
2.2. The presentation of products in our online store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code. In order to submit an offer to purchase products, an order must be placed. Utilizing the mechanisms available in our store, you may add the products of your choice to the shopping cart and submit a purchase offer. The shopping cart and the data entered into the forms may be modified prior to order placement by utilizing the available functionalities and messages displayed during the ordering process. By clicking the button confirming and finalizing the order on the order summary page, you place a binding order for the products contained in the shopping cart.
2.3. Upon placing the order, you will receive an automatically generated e-mail message confirming the registration of your order. This message is not equivalent to a declaration of acceptance of your offer and the conclusion of a sale contract. The contract of sale is concluded upon verification of whether the order can be accepted for fulfillment and upon acceptance of your offer, which occurs via a separate, subsequent e-mail message containing confirmation that the order has been approved for fulfillment. Upon receipt of such a declaration by you, the contract of sale is deemed concluded.
2.4. In the event of a refusal to accept the customer's offer and the absence of confirmation of the order for fulfillment (e.g., due to the unavailability of materials necessary to manufacture the product), any funds paid by the customer shall be reimbursed immediately, no later than within 3 business days from the date of sending the information regarding the refusal to accept the order.
3. Language and Principles of Contract Retention
3.1. The contract of sale may be concluded in the Polish and English languages.
3.2. We retain the content of the contract and send the order details along with our Regulations to you via e-mail. You may also review information regarding your orders via your customer account. The Regulations are also made available on the website of our online store in a manner that allows you to obtain, reproduce, and record their content.
4. Delivery of Products
4.1. Shipping costs must be added to the specified product prices. Ordered products are delivered via courier companies cooperating with us. Detailed information regarding the available delivery methods, timeframes, and shipping costs is presented during the order placement process and on our store's website.
4.2. The products offered in the store are sold exclusively via mail-order delivery. Personal pickup is not available.
5. Payments
5.1. The following forms of payment are available in our online store:

Cash on delivery upon receipt of the shipment.

Electronic payments (e-payments) via an online payment service.

Traditional bank transfer to the bank account of our store. In the event of selecting this method of payment, we shall send you the details required to execute the transfer via e-mail after the order has been placed. Order fulfillment shall commence upon the booking of the full required payment amount for the placed order on our account.
5.2. Detailed information regarding the available methods of payment, including the online payment services integrated with our store, available types of e-payments, and any additional costs, is presented during the order placement process and on our store's website in a dedicated information tab.
6. Right of Withdrawal from the Contract
6.1. Pursuant to the information contained in the instruction on the right of withdrawal from the contract, a Consumer, as well as a natural person concluding a contract directly related to their business activity (when such contract does not have a professional character for them), is entitled to a statutory right to withdraw from a distance contract within 14 days without giving any reason, subject to sections 6.2 and 6.3.
6.2. The right of withdrawal from a distance contract shall not apply in respect of contracts where the subject of the performance is non-prefabricated goods, manufactured according to the consumer's specifications or serving to satisfy their individualized needs (pursuant to Article 38 sec. 1 item 3 of the Act on Consumer Rights).
6.3. Bearing in mind section 6.2, the right of return (withdrawal from the contract) shall not apply to orders for personalized, customized products manufactured to the individual order of the client, including in particular products varnished or painted in a color selected by the client from the RAL palette, or modified in terms of non-standard dimensions or structural features.
7. Retention of Title
7.1. The products ordered in the store shall remain the property of the Seller until the purchase price has been paid in full.
8. Damages Incurred During Transport and Transfer of Risk
8.1. Applicable to Consumers: In the case of a consumer distance purchase, our store always bears the risk of accidental damage to or loss of the items in transit. If the ordered products are delivered with obvious damage sustained during transport, we kindly request that you report such defect to the delivery courier as soon as possible and contact us. Any delay in reporting such a complaint or establishing contact shall have no consequences for your statutory rights (as described in section 9 of these Regulations) and their satisfaction. However, prompt reporting assists us in pursuing our claims against the carrier or transport insurer.
8.2. Applicable to Entrepreneurs (including natural persons concluding a contract directly related to their business activity, regardless of its professional character): The risk of accidental loss of or accidental deterioration in the condition of the product shall pass to you at the moment of its handover by us to the forwarder, carrier, or any other person or institution engaged in the execution of the shipment (pursuant to Article 548 § 1 of the Civil Code). We shall not be held liable for any loss, depletion, or damage to the product occurring from the moment of its acceptance for transport until its handover to you, nor for any delay in shipment delivery caused by the carrier.
9. Complaints: Conformity of Goods with the Contract / Defects
9.1. Applicable to Consumers: We are obliged to deliver goods free from defects. In the event of a lack of conformity of the goods with the contract, the Consumer is entitled to the rights specified in Chapter 5a of the Act on Consumer Rights. Under the principles specified therein, the Consumer may demand the repair or replacement of the goods non-compliant with the contract, submit a declaration on price reduction, or withdraw from the contract. We shall be held liable for any lack of conformity of the goods with the contract detected within 2 years from its delivery, unless we have specified a longer shelf life/expiry date for a given product.
9.2. In the event of a lack of conformity of the goods with the contract, the aforementioned provisions regarding the Consumer shall also apply to a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it does not have a professional character for them, resulting in particular from the subject of their business activity (made available in the CEIDG).

9.4. Applicable to Entrepreneurs (with the exception of natural persons indicated in section 9.2): In the case of a sale contract concluded with an Entrepreneur, pursuant to Article 558 § 1 of the Civil Code, the statutory warranty liability ("rękojmia") of our online store for defects shall be completely excluded.
10. Services Provided by Electronic Means and DSA Point of Contact
10.1. In order to use our online store, it is necessary to possess a multimedia device with an installed web browser, access to the Internet, and electronic mail. Users are obliged to use the online store in a manner consistent with the law and good manners; the provision of unlawful content is strictly prohibited.
10.2. We commit to resolving within a reasonable timeframe any irregularities and technical issues related to the functioning of the service reported by users.
10.3. DSA Point of Contact: In accordance with the requirements of the Digital Services Act (DSA), the Seller designates the e-mail address: kontakt@bujnie.pl as a single point of contact designated for direct communication with Member States' authorities, the Commission, the European Board for Digital Services, and recipients of the service regarding any potential illegal content or violations of the regulations within the service.
11. Code of Good Practices and Review Verification (Omnibus)
11.1. We have voluntarily submitted to the "Trusted Shops Quality Criteria," which are accessible under the appropriate verification link.
11.2. In accordance with the requirements of the EU Omnibus Directive, we hereby inform you that the Seller provides access to product and store reviews. All presented reviews are collected, processed, and verified via the external Trusted Shops system. Verification consists of a technical link between the review invitation and a specific transaction; invitations are sent exclusively to customers who have actually purchased a product in our online store.
12. Provisions Regarding the Use of Trusted Shops Buyer Protection
12.1. Through the buyer protection offered by Trusted Shops SE, you may secure orders placed with us free of charge up to a maximum amount of 10,000 PLN. The Trusted Shops buyer protection conditions apply, which can be found on the service provider's website.
12.2. Buyer protection is concluded by clicking on the appropriately designated button on the Trustcard tool card, which appears as a pop-up window on the thank-you page after placing an order. This process is carried out in accordance with the personal data protection principles described in detail in our Privacy Policy.
13. Out-of-Court Dispute Resolution (including ODR Platform)
13.1. We hereby inform you that Consumers are entitled to utilize out-of-court methods of handling complaints and pursuing claims. Information on how to access the aforementioned procedure and dispute resolution methods can be found at the following address: www.uokik.gov.pl under the "Friendly settlement of consumer disputes" ("Polubowne rozwiązywanie sporów konsumenckich") tab.
13.2. Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, we provide a direct link to the online dispute resolution platform (ODR): http://ec.europa.eu/consumers/odr. The ODR platform constitutes a one-stop shop for consumers and entrepreneurs seeking out-of-court resolution of disputes arising from contractual obligations. 13.3. The use of out-of-court methods of pursuing claims is voluntary and requires the consent of both parties to the dispute.
14. Final Provisions
14.1. None of the provisions of these Regulations are intended to violate the statutory rights of the Consumer. In the event of any conflict between the provisions of these Regulations and the rights of Consumers resulting from generally applicable provisions of law – the statutory regulations shall always apply in place of the challenged provisions of the Regulations.
14.2. In the case of Entrepreneurs, Polish law shall apply to all contracts concluded with us, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
14.3. In the case of Entrepreneurs (with the exception of natural persons conducting a sole proprietorship with consumer rights, as referred to in section 1.2 in conjunction with section 6.1), the court exclusively competent for resolving all disputes arising from the contractual relations shall be the court competent for the registered office of our company.
